Descripción:
Being aware that Law and its application by courts is one of the principal tools available to governments to ensure environmental governance and sustainable development in general and particularly in LBAs, and having UNEP’s approach in mind, we aims at having a panorama on the extent to which States have translated the set of those nearly 60 principles into their legislation and jurisprudence, and at providing general patterns as to how to address coastal and marine pollution from land-based activities into national legislation, with special emphasis on tourism, municipal wastewater management, and national programmes of action for the protection of the marine environment from land-based activities (NPAs). To reach the goal, the present work reviewed and scrutinized (up to 2005): 1) 35 pieces of environmental and coastal legislation in force, coming from thirteen countries spread along the five continents;  2) 20 cases of jurisprudence belonging to equal number of countries; 3) 14 Regional Seas Programmes covering about 140 coastal States and other relevant and related environmental treaties, such as the Bio-Diversity Convention, the Convention on the Law of the Sea, the Climate Change Convention, the Convention to Combat Desertification, the Convention on Environmental Impact Assessment in a Transboundary Context, the Convention on the Protection and Use of Transboundary Watercourses and International Lakes, the Convention on the Law of the Non-Navigational Uses of International Watercourses, and the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and Their Disposal.
