AbstractThis article critically examines Apel?s thesis according to which the acknowledgement of a fundamental moral norm constitutes a transcendental condition of possibility of argumentation. Three counter-examples are presented against this thesis. The main conclusion to be drawn from them is that the normative character of the constitutive principles of argumentation is epistemic, but not moral.
