Taking the current situation as a starting point, the paper proceeds by identifying the norms toward a right to sanitation in Argentina considering it simultaneously as a public service and a human right. While it discourses about its norms and jurisprudence, it also inquires into the right’s progressive content from different subjective positions. Within this framework and with a larger work in view, it reflects about the principal causes that hinder its concretion, about the material and constitutional limitations that the judicial power presents, and about the need for a planned and progressive economic resource investment in sanitation public policies.
