Resumen:
This paper focuses on the hierarchy, scope and institutional force of norms that are implicit in a certain legal system. Particularly, it analyzes the relationship between implicit norms and expressly formulated constitutional rights. This paper defends a method for identifying implicit legal rights. According to such method we can admit that a specific right is a legal one only to the extent that we can identify a norm which is necessary to remove in order to eliminate this specific right. This method is called the elimination test. The conclusion is that we cannot determine the hierarchy and institutional force of an implicit right without a previous understanding of the role played by the test of elimination
