Paralelismos entre la Ciencia del Derecho y la Lingüística. Aproximaciones desde semejanzas en los objetos disciplinares y en los abordajes epistemológicos.

Disponible para su descarga en http://www.unlpam.edu.ar/cultura-y-extension/edunlpam/catalogo/tesis-trabajos-finales/paralelismos-entre-la-ciencia-del-derecho-y-la-lingüística.htmlEn esta investigación se ha desarrollado un conjunto de paralelismos entre dosdisciplinas: la jurídica y la lingüística respecto de tres ejes: planometafísico/plano empírico, sistema/actos individuales y sincronía/diacronía.Ello en tanto se ha partido de dos cuestiones: 1) de tres problemas que suelenderivar en objeciones hacia la cientificidad de la disciplina jurídica (alinterrogar acerca de cuál es la relación entre el Derecho como esencia y elordenamiento jurídico, por un lado, y las decisiones judiciales, por el otro;al inquirir sobre cuál es el objeto de la ?Ciencia? del Derecho, y al problematizaren torno a cómo afecta el transcurso del tiempo y los cambios al objetodisciplinar y sus descripciones); y 2) del hecho de que la Lingüística haatravesado inconvenientes semejantes y los ha superado exitosamente (al menos ala luz de los parámetros modernos de cientificidad, bajo los cuales secuestiona al campo jurídico). En este marco,el trabajo se ha estructurado en torno a dos capítulos que constituyen unbloque tendiente a dar cuenta de ciertos temas de carácter ontológico ygnoseológico y que introducen los puntos de partida para esta investigación ylas cuestiones preliminares a las comparaciones que se efectúan, y trescapítulos en los cuales se desarrollan los paralelismos propuestos entre la?Ciencia? del Derecho y la Lingüística.A la luz deestos problemas y planteos, para efectuar la tarea contrastiva, se handesarrollado dos modelos de ?Ciencia? del Derecho. El primero se inscribe enuna visión predominantemente positivista en cuanto al recorte del objeto deestudio científico, mientras que el segundo se inspira en una perspectivarealista clásica y logra una mejor combinación de los distintos niveles delconocimiento jurídico, principalmente el filosófico y el científico. AbstractThis research work is focused on three parallelisms between twodisciplines: the legal one and Linguistics and is built around three axes:metaphysical facet/empirical facet; system/individual acts; synchronicperspective/diachronic perspective. The departing point has been: 1) theexistence of three objections to recognizing the scientific characteristic ofthe ?Science? of Law (a. the relation between Law as a metaphysical substanceand the empirical manifestations; b. the link between legal systems andjudicial decisions; and c. the problem of the changes in the scientific object);and 2) the existence of similarities between the way Linguistics study itsobject and how the ?Science? of Law studies its own; similarities that exist incharacteristics that made Linguistics be accepted as a science and legaldiscipline be questioned on its scientific characterization (at least,according to the modern conception of sciences). Under this frame, this work is structures in two blocks of chapters: thefirst one includes certain ontological and epistemological topics in order toexplain the departing points of this thesis; and the second one in which thethree parallelisms are presented. To carry out with the contrastive work, two models of the ?Science? ofLaw have been presented. The first one follows a positivist vision and thesecond one is inspired on a classical realist perspective. This last proposalis affirmed to combine in a better and more coherent way the different level oflegal knowledge.
