LA CONTROVERSIA POR EL GLIFOSATO EN LA ARGENTINA: CAMINOS REGULATORIOS ANTE EL RIESGO AMBIENTAL Y DE SALUBRIDAD PÚBLICA

La cuestión del uso del glifosato sobre todo enla producción agraria en plantaciones transgénicas nos sitúa en una encendida controversia entre sus defensores y detractores, no sólo en la Argentina sino en el mundo entero. Las empresas y productores hablan de las bondades de esteherbicida en la producción y que se trata de un agroquímico o fitosanitario, mientras que los médicos y poblaciones plantean las enfermedades y la contaminación que genera en tanto agrotóxico y veneno. Los valores de producción de soja transgénica demuestran que la Argentina es uno de los más grandes productores en el mundo. Ante este panorama la pregunta que atraviesaesta ponencia se refiere a la responsabilidad del Estado en materia de la regulación del glifosato. El desarrollo de este texto seexpone en tres partes, en primer lugar, se presenta un racconto sobrealgunos hechos destacados que permiten visualizar las disputas ante la causadel glifosato tanto en plano científico como legal. En segundo lugar, seaborda la siguiente pregunta: cómo tutelar derechos fundamentales. En tercerlugar, se propone una estrategia de abordaje de esta problemática desde elderecho por medio de una legislación de presupuestos mínimos en materiaambiental que se aboque a regular el uso del glifosato, en virtud al interéscolectivo que supone la protección de la salud y del ambiente. Por último, sepresentan reflexiones finales en relación al desafío público que significatratar la controversia que origina el glifosato más allá del herbicida.  Resumen en inglés: Theissue of use of glyphosate especially in the agrarian production in transgenicfields places us in a passionate controversy between defenders and detractors,not only in Argentina but all over the world. The companies and producers speakabout the kindness of this herbicide in the production and named it as anagrochemical or phytosanitary, whereas the doctors and populations raise thediseases and the pollution that it generates and named it as agrotoxin andpoison. The figures about production of transgenic soybean demonstrate thatArgentina is one of the biggest producers in the world. In the face of thispicture the question that crosses this paper refers to the State responsibilityregarding the regulation of glyphosate. Thedevelopment of this text is exposed in three parts, first, a racconto about some out-standing factswhich allow to visualize the disputes in the light of the cause related toglyphosate in the scientific and the legal level. Secondly, the followingquestion is approached: how to safeguard fundamental rights. Thirdly, isproposed a strategy of facing this problematic from the law by means of aminimum-budget environmental legislation, which approaches to regulate the useof glyphosate in virtue to the collective interest that supposes the health andenvironmental protection. Finally, are showed final reflections in relation to thepublic challenge that means to treat the dispute that the glyphosate originatedbeyond the herbicide.
