The relationship between social protection and care politics in Argentina is a new topic of interest. A lot of reasons promote this discussion. One of the topics is the reform on the adjustment programmes applied in the nineties in Latin America and the consequences for the social system, in terms of more poverty, more unemployment, and the direct consequences on the economic, social and cultural rights (ESCRs). Parallel to these reforms, states have made important changes in their constitutions and have adopted the principal human rights treaty and protocol. In this context, labour regulations tend to be limited to the protecton of working mothers during the pregnancy, childbirth, postpartum and breastfeeding, but not consider the orther care situation (the elderly, sick people). In fact, the steep rise in women´s participation in the paid labour market wich was no balanced out by mens participation in caregiving, this overburderns women with work and obligations and is detrimental on their job and wage trajectory. In this paper, I would like to discuss how is important to approach taken must therefore enage complementary perspective ?care rights, gender equality and universal social policies in dialogue. Instead, the focus has been placed on various immediate obligations related to social rights, the social protection system in Argentina and proposal to make a public policies agenda more to reduce inequalities.
